The Fair Use Policy is available in order to provide a clear understanding of the rules, regulations and restrictions regarding the use of Aeronautic Vigilante’s services. PLEASE ABIDE BY IT STRICTLY. By using our services, you agree to abide by this Fair Use Policy.
Unlimited Bandwidth, Disk Usage, Email and FTP accounts and other Unlimited Resources
Aeronautic Vigilante provides Users with bandwidth, disk space and other resources, such as e-mail, mysql databases, and/or file-transfer-protocol (“FTP”) accounts, the amount of which is defined in Aeronautic Vigilante’s web pages describing the package of Services purchased at the time of purchase. In some cases, Aeronautic Vigilante may not establish a specific amount of bandwidth, disk space and other resources, and refer to that as “Unlimited”. In all cases, the Services are intended for normal use only, and any activity that results in excessive usage that is inconsistent with normal usage patterns is strictly prohibited. Aeronautic Vigilante reserves the right to suspend, discontinue or delete the accounts of Users whose use of disk space, bandwidth or other resources results in or presents the risk of degradation of service to other customers, regardless of the amount of disk space, bandwidth or other resources included in the User’s plan. User agrees that such usage shall not exceed the amounts set by Aeronautic Vigilante for the Services purchased (the “Agreed Usage”) and is additionally subject to normal usage guidelines established by Aeronautic Vigilante as in effect from time to time. These allotments are optimized and dedicated towards serving the Content and User’s active electronic mail services related solely to User’s web hosting account(s) with Aeronautic Vigilante.
Hosting space is intended for normal use only, and is limited to Web files, active e-mail and content of the hosted Web sites, not for storage (whether of media, e-mails, or other data). Hosting space further may not be used as offsite storage of electronic files, electronic mail or FTP hosts. You are responsible for removing any files, e-mails or other data which do not meet these requirements, and for adhering to any usage requirements or limits allocated to your account(s). Failure to do so may result in removal and deletion of such materials (including without limitation files and e-mails), and/or in discontinuation of your services or account, which actions we may take in our sole discretion.
Aeronautic Vigilante may monitor User’s use of bandwidth, disk usage and other resources. Aeronautic Vigilante, in its sole discretion, shall have the right to take any corrective action if User’s utilization of bandwidth, disk usage or other resources exceeds the Agreed Usage, or normal usage by our typical shared hosting customer, resource usage, or is used for other improper storage or usage. Such corrective action may include the assessment of additional charges, disconnection or discontinuance of any and all Services, removal or deletion of User’s Web site, User Content, User’s electronic mail and e-mail services and/or other materials and services or termination the User’s account and of this Agreement, which actions may be taken in Aeronautic Vigilante’s sole and absolute discretion.
Unlimited Domains
Unlimited domains refers to subdomains and parked domains. In all cases (even those described as “unlimited”), the Services are intended for normal use only, and any activity that results in excessive usage that is inconsistent with normal usage patterns is strictly prohibited. Aeronautic Vigilante reserves the right to suspend, discontinue or delete the accounts of Users whose use of unlimited subdomains and parked domains results in or presents the risk of degradation of service to other degradation of service to other customers, regardless of the amount of domains included in the User’s plan. User agrees that such usage shall not exceed the amounts set by Aeronautic Vigilante for the Services purchased (the “Agreed Usage”) and is additionally subject to normal usage guidelines established by Aeronautic Vigilante as in effect from time to time. These allotments are optimized and dedicated towards serving the Content and User’s active electronic mail services related solely to User’s web hosting account(s) with Aeronautic Vigilante.
User is responsible for complying with any usage requirements or limits for bandwidth, disk space or other resources, and monitoring such usage to ensure the Web site does not violate such requirements or exceed normal usage limits, Agreed Usage, or other limits allocated for the account(s) and otherwise complies with this Agreement. Aeronautic Vigilante will use commercially reasonable efforts to e-mail Users who are at or near their utilization limits, but Aeronautic Vigilante does not take responsibility if e-mail notification(s) is not received by the User. Aeronautic Vigilante reserves the right to discontinue service through the beginning of the next month for your account in the event that it exceeds the any such allotment.
If Aeronautic Vigilante takes any such corrective action under this section, User shall not be entitled to a refund or credit of any fees paid prior to such action.
Disproportionate Server Loads
While our shared services are suitable for personal or small business customers, there comes a time for some websites when they are better suited for a larger plan, which allows for more dedicated CPU and memory resources. We reserve the right, in our sole discretion, to discontinue service to any customer with a website or other hosted data that takes up server resources over 20%, longer than 90 seconds in any consecutive 6 hour period. This means that if your website is found to be utilizing more resources of the CPU and/or memory of our server, we reserve the right to take your site offline. Due to the severity of this, and our ability to act quickly to correct these situations to avoid server issues, we will do everything reasonably feasible to provide you with a warning prior to taking your site offline, but we accept no obligation to do so.
INODES (File Usage)
Soft Limit: 100,000 inode ~ Hard Limit: 250,000 inode
We will not provide services to use more than 250,000 inodes per cPanel hosting account. cPanel accounts found to be exceeding the 100,000 inode limit will automatically be removed from our daily backup system this is done in order to prevent file system damage and cPanel backup files that were already uploaded to Amazon S3 will be deleted. Exceeding 250,000 inodes the cPanel account will be Permanently Suspended (without notice), the restoration fees is $25 USD per cPanel account.
By default, all cPanel hosting accounts have a “File Usage” limit, this is also known as the inode limit. We place file limits on cPanel accounts to keep our systems up and running optimally. Hosting a large number of files on a shared web server can cause issues for the server’s file system and also adversely affect the performance of the backup system when it comes to both backing up and restoring data.
The file count includes all files, and folders on your webspace. You can view your current file usage by logging into cPanel and looking under the “Statistics” heading down the side of the page, look for the reading indicated as “File Usage”. Every file (a webpage, image file, folder, email, etc) on your account uses up 1 inode. Sites that slightly exceed our inode limits are unlikely to be suspended; however, accounts that constantly create and delete large numbers of files on a regular basis, have hundreds of thousands of files and folders, and cause file system damage will be permanently suspended.

Preventative or Corrective Action**
However, in accordance with our Terms of Service, we may remove any materials that, in our sole discretion, may be illegal, may subject us to liability, or which may violate this Fair Use Policy. Aeronautic Vigilante may cooperate with legal authorities and/or third
parties in the investigation of any suspected or alleged crime or civil wrongdoing.
Aeronautic Vigilante reserves the right to take reasonable preventative or corrective action to ensure that compliance with its Fair Use Policy is adhered to by all users of the service. Your violation of this Fair Use Policy may result in the suspension or immediate termination of your account or other services WITHOUT ANY PRIOR NOTICE. Acceptance and adherence to the Aeronautic Vigilante’s Fair Use Policy (FUP) is a part of the Aeronautic Vigilante’s Terms of Service (TOS) to which each user of the service has agreed to.
